Born in Santiago de Cuba, José Gabilondo joined the College of Law after working in financial market regulation at the U.S. Department of the Treasury, the U.S. Securities and Exchange Commission, the Office of the Comptroller of the Currency, and the World Bank. He served as Associate Dean for Academic Affairs from 2009-2011. Professor Gabilondo teaches corporate finance, banking regulation, tax, and Profesión Jurídica Comparada, a Spanish-language course on foreign and comparative law. His scholarship focuses on financial markets and Cuba legal studies. He has presented at the Universities of Chicago, Buffalo, Havana, Columbia, Maryland, DePaul, Emory, Florida State, Georgetown, and Wake Forest, Universidad Nacional Autónoma de México, American University, Cuba’s Unión Nacional de Juristas, and the Instituto Tecnológico Autónomo de México. His work has appeared in the Journal of Corporation Law, Wake Forest Law Review, Catalejos, Seton Hall Law Review, UNIjuris(Cuba), Maryland Journal of Business & Technology Law, and the Wisconsin Journal of Law, Gender, and Society, among others. He is the author of Bank Funding, Liquidity, and Capital Adequacy: A Law and Finance Approach and co-author of Corporate Finance: Debt, Equity, and Derivative Markets and their Intermediaries, in the American Casebook Series. He has been a featured speaker at meetings of the Latin American Law and Economics Association, the Association for the Study of the Cuban Economy, Organización Nacional de Bufetes Colectivos (Cuba), the American Society for International Law, the American Association of Law Schools, the Georgetown University Conference on Socio-Economics, Law and Society, the American Association of University Professors, LatCrit, and the Latin American Studies Association. He is a nationally recognized commentator in the Spanish-language media on financial and economic matters.Professor Gabilondo is currently working on a book about business models for financial intermediation.

Professor H.T. Smith Quoted on the Passing of Justice Hatchett

Professor H.T. Smith is quoted by Law360 and The Miami Herald on the passing of former Florida Supreme Court Justice Joseph W. Hatchett, the first Black member of the state’s highest court.  He was 88.

“The legacy of Justice Hatchett,” Professor Smith is quoted, “was that he himself, and through his mentoring of Black lawyers, opened the vaults of opportunity in every field of legal endeavor – public practice and private, federal and state – so that almost all Black lawyers are in some important way of his lineage.”

“Like Jackie Robinson,” Professor Smith continued, “Justice Hatchett was not just first person, but just that special type of person to break seemingly impenetrable barriers.  He was professionally excellent, and personally humble.  And that made it that much easier for all who followed.”

Justice Hatchett also made history as the first Black judge appointed to a federal circuit appeals court in the Deep South, and the first Black person in the 20th century to win a statewide contested election in Florida.

This spring semester I had the opportunity to intern at Carlson Law in Miami Beach. I worked alongside attorney Chase Carlson, who is a 2010 FIU Law alumnus [he also holds a Master of Science in Finance from FIU] and the founder of Carlson Law. The firm specializes in representing investors, many of whom are athletes, against financial advisors, investment advisors, brokerage and wealth management firms. Mr. Carlson has been featured in the Washington Post and is often sought out as counsel as the go-to attorney athletes hire to recover their money.

Professor Carpenter was recently quoted in the Wall Stree Journal regarding recent proposals to remove commanders from the military justice system.

Professor Eric Carpenter is a nationally recognized expert on military law, death penalty litigation, and sexual assault law and policy. He routinely provides relevant, insightful, engaging, and unbiased commentary on these topics to the media, including The Today Show, CBS Radio, the Wall Street Journal, Time Magazine, and the Associated Press, to name a few. He was also a cast member on the Starz true-crime documentary, Leavenworth.

Professor Carpenter lived and worked in the world of military justice. He served in the Army as a helicopter pilot and is a graduate of Ranger School and Airborne School. He was a judge advocate, serving as a prosecutor, supervising defense counsel, and Chair of the Criminal Law Department at the Army’s law school. He deployed to Afghanistan in 2003. He is an elected member of the National Institute of Military Justice and the ABA’s Military Justice Committee, and he continues to write influential articles on military justice system reform.

Professor Carpenter is still active in death penalty litigation. He is a consultant on the 9/11 commissions at Guantanamo Bay, Cuba, and advises judge advocates who defend service members in capital courts-martial. His experience is deep—while in the Army, he served as the lead defense attorney on a capital murder case and was part of the task force that wrote the current regulations for capital litigation in the Army. He is a member of the National College of Capital Voir Dire and speaks regularly on this trial technique around the country. He has written several articles on how jurors view the death penalty.

Today, he actively works to improve the legislation and law enforcement of sexual assault. As an elected member of the American Law Institute, he works on the ALI’s project to reform the Model Penal Code’s sexual assault and related provisions. While in the Army, he helped develop training and policy to address the sexual assault issue in the military. He focuses his scholarship on improving law enforcement processing on sexual assault cases and providing relevant information that policymakers can use when deciding how to reform the civilian and military systems.

FIU Law Strengthens its International Presence by joining the Iberoamerican of Association Law Schools (SUI IURIS) as Permanent Member

The Iberoamerican Association of Law Schools (SUI IURIS) just approved unanimously the accession of FIU Law as permanent member during its XII Annual Meeting held on May 19, 2021. As a result, FIU Law will join the 29-member organization formed by the most prominent law schools from Argentina, Brazil, Chile, Colombia, Spain, Mexico, Peru, Portugal, and Venezuela.  SUI IURIS offers a strong support network for academic collaborations, including law journals, visits and exchanges of professors and researchers, continuing legal education and other educational opportunities for students and faculty.

Prior to becoming a permanent member, FIU Law held observer status at the organization for three years. Gilberto A. Guerrero-Rocca, director of the FIU Law LL.M. program, was responsible to lead this effort to fruition and will continue to serve as FIU Law’s point person with the organization. This important milestone is the latest demonstration of FIU Law’s successful strategy toward expanding its international reach and strengthening its presence throughout Latin America and Europe.

Rising 2L Daniel Elliot Gonzalez Co-Authors “Playing With Fire: The Strange Case of Marine Shale Processor”

Rising 2L Daniel Elliot Gonzalez has co-authored Playing With Fire: The Strange Case of Marine Shale Processors published by Hamilton Books.  Upon its release, the book was ranked as the #1 New Release on Amazon for Environmental & Natural Resources Law.

Mr. Gonzalez was brought on to co-author alongside Dr. John Sutherlin at the University of Louisiana – Monroe, who was inspired to write this book following a trip to Marine Shale Processors in graduate school. 25 years later, Dr. Sutherlin and Daniel have uncovered the story behind what was once the largest hazardous waste incinerator in the world, the women-led environmental justice movement that spawned from the company’s pollution, and the events that led to Marine Shale’s eventual downfall.

Mr. Gonzalez graduated with a bachelor’s degree in political science in 2018 and a master’s degree in history in 2020 from the University of Louisiana – Monroe. At FIU Law, Mr. Gonzalez is the outreach coordinator for the Environmental Law Society.

Summary: Playing with Fire chronicles the ongoing struggle facing Louisiana families trying to live and work against the backdrop of corrupt politicians and corporate greed. However, the story presented here is relevant wherever low-income, disenfranchised people are not included in decisions about their health and environment. This book examines the tale of Marine Shale Processors, the world’s largest hazardous waste company, and the women who fought to protect their community and their children. The lesson here is that a dedicated group of people fighting for what is right can win and it serves as an example for any community that wants to determine what their own environmental future. Playing with Fire is a well-documented account that provides lessons for communities, government agencies, and corporations. It dispels the narrative that low-income communities must settle for jobs at the expense of clean air and water, and demonstrates that corporations that further trample on the rights of people will ultimately pay the price.

Mason as a member of the Council for Diversity in the Educational Pipeline for a one-year term commencing with the adjournment of the 2021 Annual Meeting. In this role, Dean Mason will focus on continuing the mission of the Pipeline Council, which is to increase diversity, equity, and inclusion in the educational pipeline to the legal profession.
